Mind the Chap collects certain information when you interact with the Mind the Chap website. For example, the Site may collect “Personal Information” which is data that can be used to identify an individual, as defined by applicable law. The Site may also collect data that does not identify you specifically. The following is a list of data that we may collect and process about you:
• Information that you provide by filling out forms on the Site. This includes information you provide when you register for an account, make a purchase, subscribe to any services offered on the Site including but not limited to interactive services (such as blogs, chat rooms, message boards, or other user forums); enter a competition or promotion sponsored by Mind the Chap; complete a survey; or report a problem with the Site;
• Any information you may provide when you contact us or send us a correspondence;
• Any information obtained as a result of authentication or identity checks when you contact us or send us correspondence;
• Details of any transactions you carry out through the Site including the placement of any orders by you or any others that may have resulted in a gift or shipment to you. If an order is placed with us, we need to hold personal information including your name, email address, phone numbers, home address, shipping and credit/debit card billing address(es) so that we can process and fulfill your order. To protect your privacy we do not save credit/debit card information on the Site. Sometimes we may ask for your telephone number. This number may be given to our courier for delivery services. These details allow us to process your order and to let you know the status of your order; and
• Details of your visits to the Site including but not limited to, your computer’s IP address, your account password information, page interaction information, traffic data, location data, weblogs, and other data about the resources that you access.
We may also collect personal information about you from other third parties, such as demographic firms, to make our future service and marketing efforts more efficient and personalized for you. We also gather certain information automatically and store it in log files. This information includes Internet Protocol (IP) addresses, browser information, Internet Service Provider (ISP), operating system, date/time stamp and clickstream data.
When you register with Mind the Chap, you will be offered the opportunity to opt out of our emails, correspondence and other update services. If you choose to opt-out for this service, we will not send you alerts for new products, features nor enhancements; special offers; upgrade opportunities; contests or events of interest. However, if you choose to receive our emails and/or correspondence, from time-to-time we will use the information you provide to promote the products and services of our business partners via email or direct mail.
We use your personal information that we collect to conduct our business and to provide you with the best possible products, services and experience. To best serve you, we may share your personal information with service providers that provide support services to us or that help us market our products and services. Service providers, third parties who perform services on our behalf, are contractually restricted from using your personal information in any manner other than in helping us to provide you with the products and services available from Mind the Chap. We may also, in certain instances, disclose your personal information when we have reason to believe that it is necessary to identify you, contact you, or bring legal action to protect your rights or the rights of Mind the Chap or others. We may also disclose your personal information when you ask us to do so or when we believe it is required by law.
A cookie is a small data file that is placed on the hard drive of your computer when you visit a website. A “session cookie” expires immediately when you end your session (i.e., close your browser). A “persistent cookie” stores information on the hard drive so when you end your session and return to the same website at a later date, the cookie information is still available. A web beacon is a small string of code that represents a clear graphic image and is used in conjunction with a cookie.
When you visit the Site, we may use both a session and a persistent cookie. This Mind the Chap-placed cookie may contain information (such as a unique user ID) that is used to track your usage of the Site and in some cases, your e-mail address. Your e-mail address is only saved in this Mind the Chap -placed cookie if you register with us. A web beacon allows us to capture certain additional types of information about a visitor’s actions on a website, such as a visitor’s cookie number, the time, date, duration and number of page views, a description of the page where the Web beacon is placed, and details about any items that were purchased.
We may use Flash Cookies (also known as Local Stored Objects) or other similar technologies. A Flash cookie is a small data file placed on a computer using Adobe Flash technology that may be built into your computer or downloaded by you to your computer. We use these technologies to personalize and enhance your online experience, facilitate processes, personalize and store your settings. Flash cookies may help the Site visitors to, for example, set volume preference associated with a video experience, play games and perform surveys. They help us improve the Site by measuring which areas are of greatest interest to customers. We do not use Flash cookies for marketing or behavioral targeting purposes. Flash cookies are different from browser cookies and the cookie management tools provided by your browser will not remove Flash cookies. If you disable Flash cookies or other similar technologies, please be aware that you may not have access to certain features and services that make your online experience more efficient and enjoyable.
When you register, you will be given the option to opt-out of subscribing to our regular update service.
At all times, we will offer you the opportunity to opt-out of any service to which you have subscribed. Any email we send you will contain an easy automated opt-out link so that you can opt-out of that particular mailshot. Simply follow the indications in the email. Alternatively you can change your email preferences or opt out of all emails by logging into My Account. To opt out of direct mail service or updates, please contact Mind the Chap by email firstname.lastname@example.org. It is not our current policy to share our customers’ personal information with third parties other than as stated herein.
Should you choose to have your name and personal information removed from our database altogether, you can do so by sending an email to email@example.com or by writing to us at: Mind the Chap, 911 Central Avenue, Albany, NY 12206.
If for any reason you are concerned that the personal information held by Mind the Chap is not correct, please visit the website and, after logging into My Account on the home page, your personal information will be made available for review and change. Only you or, upon your request, the Customer Service department, may access your personal information from the website using your password and User ID. Information may be changed online within My Details, Shipping Details, and My Email Preferences. If you change your billing or shipping address while your order is still being processed, the order will be re-processed through security validation checks. If you prefer, you may contact us by email at firstname.lastname@example.org and we will amend your personal information.
Protecting children’s privacy is important to us. The Site is a general audience site. We do not collect or maintain information from those we actually know are under 13, and no part of the Site is targeted to attract anyone under 13. We also do not send email correspondence to anyone who tells us that they are under the age of 13 without their parent’s consent.
Children under the age of 13 should always ask their parents or guardians for permission before providing any personal information to anyone online. We urge parents and guardians to participate in their children’s online activities and use parental control or other web filtering technology to supervise children’s access to the web.
We will only collect personal information to the extent deemed reasonably necessary to serve you in view of our legitimate business purposes as set out above, and we will use and maintain appropriate safeguards to ensure the security, integrity and privacy of the information you have provided us with. When you place an order or access your account information, we use a Secure Socket Layer (SSL) encryption, which encrypts your information before it is sent to us to protect it from unauthorized use. In addition, we will take reasonable steps to ensure that third party business partners to whom we transfer any data will provide sufficient protection of that personal information. Unfortunately, the transmission of information via the Internet is not completely secure. Although we will do our best to protect your personal Information, we cannot guarantee the security of the data you transmit to the Site; any transmission is at your own risk. Once we have received your information, we will use reasonable efforts to try to prevent unauthorized access.
In the unlikely event that we believe that the security of your personal information in our possession or control may have been compromised, we may seek to notify you of that development. If a notification is appropriate, we would endeavor to do so as quickly as possible under the circumstances.
